Bernards Township Planning Board Regular Meeting - 7:30PM June 2, 2026
Tuesday, Jun 2, 2026
Planning Board Receives Comprehensive Overview of Redevelopment Law and Process
During the planning board meeting, a detailed presentation was given on the Local Redevelopment and Housing Law (LRHL), outlining the process, powers, and criteria for designating an area in need of redevelopment. The presentation covered the history of the LRHL, the roles of the planning board and governing body, the procedural steps including public hearings and noticing requirements, and the eight criteria an area must meet. It also explained the components of a redevelopment plan, the difference between superseding zoning and overlay zones, and the potential for negotiating with developers. The presenter emphasized that the planning board's role in the initial investigation phase is to assess whether criteria are met, not to design the redevelopment plan itself.
Planning Board Approves Resolutions for Fellowship Village Application
The planning board reviewed and approved two resolutions memorializing previous determinations regarding the Fellowship Village, Inc. application. The first resolution, PB13006C, concerned an annual parking report. The second resolution, P220005B, involved a modification of conditions for the Fellowship Village development located at 8000 Fellowship Road and 55 Allen Road. Both resolutions were drafted by Mr. Drill and reviewed by professionals and the board. Eligible voters were identified for each motion.
Planning Board Grants Variance for Setback Encroachment After Agreement on Screening Trees
The planning board heard testimony and deliberated on a request for a C2 variance related to an encroachment into a setback area for an apartment within a single-family residence at 174 South Finley Avenue. The applicants, William and Virginia Karns and Michael and Mary Francis Vicaro, sought to legalize an addition that encroached approximately 38.5 inches into the 50-foot setback. The board confirmed the apartment's status as a permitted conditional use, establishing jurisdiction for the variance request. An agreement was reached with the objecting neighbors, Heidi Emily Landry and Hank Bare, involving the planting of screening trees along a 120-foot section of the property line. The board ultimately granted the C2 variance with the condition that the planting be completed by November 15, 2026. The case number for this application was PB24002A.
