Gardner Approves Fireworks Stands in Recreational Zoning District
The Council considered and adopted Ordinance 2879, amending Section 10.35C4 of the Gardener Municipal Code to allow fireworks stands in the RECC (Recreational) zoning district. Previously, fireworks stands were not permitted in this district. The amendment was prompted by an inquiry about placing a fireworks stand on the county fairgrounds, which is zoned RECC. The ordinance does not waive other requirements, meaning fireworks stands will still need to obtain permits, undergo site plan review, and meet all other performance requirements outlined in the Uniform Offense Code. The discussion clarified that the RECC zoning district is unique and specifically intended for areas with multiple outdoor functions and diverse activities. It was noted that adjacent zoning includes R5 and R2, and separation distances from residential uses would still need to be met. The possibility of other properties being zoned RECC in the future was acknowledged.
Gardner Council Votes Against Data Center Moratorium
The Council considered adopting Resolution 2193, which would impose a six-month moratorium on the acceptance or consideration of applications for data centers. The purpose of the moratorium is to allow staff time to study the issue further, as current zoning and development standards may be inadequate for the unique characteristics, demands, and potential cumulative effects of data centers. This would give staff time to develop recommendations for potential revisions to the land development code and other related standards. The discussion involved extensive debate about the pros and cons of data centers, including potential economic benefits, environmental concerns (water usage, noise, light pollution), and the need for clear definitions and regulations. Some council members expressed concerns that a moratorium might prohibit development and lead to legal challenges, while others argued it was necessary for responsible governance and community input. Ultimately, a motion to adopt the resolution failed due to lack of a second, meaning the moratorium was not imposed.
