Variance Granted for Setback Issue in Hubble Cove Residential Property
The board considered a variance request (VR 2612) to address a setback issue for a residential property. The original developer failed to complete a cul-de-sac in 1973, leading to the current house being built too close to the intended road. The current owner needs the variance to clear title and finalize a sale, as the house is approximately 1.5 feet from the unconstructed cul-de-sac right-of-way. The property is located in Hubble Cove, north of town, and is undergoing a rezoning from RM8 to RS5 (single-family).
Variance Approved for Lot Split, Avoiding Subdivision Regulations for Adjacent Property
The board approved a variance related to subdividing a 0.44-acre tract into two single-family residential lots. The request stemmed from a previous lot split approximately 14 years prior, which if counted under current subdivision regulations, would require the creation of three lots and trigger stormwater management and sidewalk requirements for an adjacent, separately owned property. Granting the variance allows the creation of two lots that will conform to zoning requirements, avoiding these additional burdens on the neighboring property and the developer. A discussion was held regarding the lack of a time limit on previous lot splits and the potential precedent set by similar past decisions.
