Lakeway Commission Recommends Zoning Code Changes to Streamline Business Permits, Excludes Certain Uses
The commission discussed and made a recommendation on a proposed ordinance amendment to the city's zoning code concerning Special Use Permits (SUPs) and Conditional Use Permits (CUPs) in commercial districts (C1 and C2). The amendment aims to streamline processes for businesses by removing redundancies, making certain uses permitted by right, and allowing SUPs to remain valid indefinitely unless materially changed. Key changes include removing SUP/CUP requirements for medical offices, restaurants, and retail based on proximity to residential areas, and allowing existing drive-through facilities to continue without new SUPs upon ownership change. The commission recommended approving the ordinance amendment with modifications: excluding medical research laboratories, restaurants, and fast-food restaurants from being permitted by right, and recommending council and staff explore options for continued citizen awareness of administrative changes. The motion passed (4-0).
Lakeway Commission Denies Take-Five Oil Change SUP
The commission reviewed a request for a special use permit for a Take-Five Oil Change drive-through at 2305 Ranch Road 620 South. The former gas station site had its storage tanks removed due to being in the right-of-way for road widening. The applicant, an architect representing the owner, presented renderings and noted that a variance for garage doors facing Amino Drive would be required. The commission discussed the competitiveness of the market with existing oil change facilities and the visual impact of the proposed facility at a prominent intersection. Public comments were noted as not being in favor. After discussion, the commission voted to deny the SUP request, which will move to city council for a final decision, requiring a supermajority to pass.
Lakeway Commission Approves Storage Facility SUP After Neighbor Dispute
The commission considered a request for a special use permit for 15616 Stewart Road and 1106 Ranch Road 620 North, a former CubeSmart location now operated by Public Storage. The permit transfer was largely a housekeeping item due to a change in ownership. A neighboring property owner raised concerns about commercial moving trucks encroaching on their property line and requested the installation of a masonry wall as a condition for the permit approval. The applicant, Jackson Walker LLP, stated they were unaware of the issue and proposed discussing it with the neighbor and potentially installing signs. The commission recommended that the two parties discuss the issue outside of the meeting and moved to approve the SUP for 99 years, with the understanding that any further disputes would be addressed at the city council level.
Lakeway Commission Determines Lakeside Estates Homes Not View Blocking
The commission considered a view blocking determination for new homes at Lakeside Estates, located at 570 Rubin, comprised of 10 lots. Drees Custom Homes submitted three applications, with ridge poles installed for each, all under the maximum allowed height of 32 feet. The property is zoned R1 and is surrounded by R4 and R1 zoning districts. Staff presented information on existing subdivision height determinations in the city. The commission found no lake view from the property. After a site visit and review of the submitted information, the commission determined that the proposed structures do not pose a view blocking issue and voted to approve the determination (4-0).
Lakeway Commission Approves Oversized Anniversary Banner for Baylor Scott and White
The commission considered a variance request from Baylor Scott and White Medical Center for an oversized temporary banner to commemorate their 10th anniversary in Lakeway. The banner, measuring 167 square feet, exceeds the normal banner code limit of 24 square feet. The banner's message is 'Thank You for 10 Years, Lakeway.' Five public comments were received, all in support. Commissioners discussed whether the banner, despite its celebratory message, constitutes commercial signage and potentially sets a precedent. They also considered the distinction between different types of restaurants and the implications for future zoning code amendments. Ultimately, the commission voted to approve the variance request (4-0).
