Subdivision Application at 165 Summit Ave Kept Open for Reconsideration Due to Density and Circumvention Concerns
The Planning Board considered a subdivision application for a 31,410 sq ft lot at 165 Summit Avenue, proposing to divide it into three lots: Lot A (12,546 sq ft), Lot B (13,836 sq ft, containing the existing house), and Lot D (5,000 sq ft). The applicant aims to sell the subdivided lots to recoup investment and renovate the existing historic house. Residents expressed concerns about increased density, parking, traffic, flooding, and environmental impact, arguing that the subdivision could circumvent previous denials related to density. The board, noting that the previous denial was for a four-lot subdivision with proposed improvements, acknowledged the current application is for a three-lot subdivision with reduced density. Council advised that enforcing restrictions on future development of subdivided lots might be difficult. The board voted to keep the public hearing open to allow the applicant to potentially reconfigure the subdivision, possibly into two lots, and scheduled further discussion for the next meeting.
Planning Board Approves Special Education Preschool Special Permit
The Planning Board considered an application for a special permit to operate a special education preschool program for children with disabilities. The applicant, Rising Ground, proposed to lease existing classroom space from Sinai Free Synagogue. The program serves children ages 3-5 and is funded by the New York State Education Department. Concerns were raised regarding the applicant's lack of a Board of Regents charter, but the applicant argued that their 4410 certification under the NYS Education Law served as an equivalent regulatory framework. The board ultimately approved the special permit with one dissenting vote, allowing the program to continue.
Chase Bank Branch Conversion Approved by Planning Board
The Planning Board considered a site plan and special permit application to convert a portion of an existing building into a Chase Bank branch. The project involves interior alterations, the relocation of ATMs inside the building, repaving parking stalls, reconstructing sidewalks for ADA compliance, and upgrading site lighting. The applicant agreed to move ATMs indoors following board recommendation and to maintain camera footage for 90 days. The board approved the application.
