Conservation Commission Classifies Fennell Street Channel as Canal, Acknowledges Historical Dumping
The Conservation Commission deliberated on a request for a determination of applicability (RDA) concerning a concrete-lined diversion channel and historically dumped grounds at Fennell Street, adjacent to the Revere Chelsea line and Northeast Expressway. The applicant, VHB, sought confirmation that the channel meets the definition of a 'canal' under the Wetlands Protection Act, thereby establishing a 100-foot buffer zone and no riverfront area. They also requested confirmation of historically dumped grounds, existing prior to August 7, 1996, to allow for cleanup and potential development. Commissioners discussed the channel's man-made nature, poor condition, and tidal influence. There was consensus that the channel functions as a canal. Regarding the dumping grounds, commissioners agreed that dumping occurred but debated the extent and limits, ultimately voting for a positive determination that historical dumping occurred but further analysis is required to define the precise limits. The commission also noted concerns about the condition of the stormwater outfalls and the need for maintenance by MassDOT.
12-Unit Multifamily Development Approved at 1165 North Shore Road
The Conservation Commission reviewed a notice of intent for the demolition of an existing dwelling and the construction of a 12-unit multifamily dwelling with podium parking at 1165 North Shore Road. The project is located in a floodplain, and the proposal includes demolishing the existing structure, which acts as an impediment, and replacing it with a design that allows for increased floodplain capacity and floodwater flow. The new structure will have living spaces elevated significantly above the floodplain. The commission discussed the project's impact on flood storage, stormwater management, and potential shadows or sun blockage for neighbors, with assurances that the design would not cause significant negative impacts and that the building height was within allowed limits. Geotechnical investigations revealed poor soil conditions (clay and peat) precluding infiltration systems. The commission approved the notice of intent.
